Living Common Law

Instead of getting married, many people choose to live together (to live “common law”). Whereas legally married couples must obtain a Divorce, there is no legal procedure to end a common law relationship.

The law does treat common law couples differently and it is important to obtain legal advice regarding your rights and responsibilities after a breakdown of a common law relationship. As with married couples, decisions may have to be made with respect to child custody and child maintenance, “spousal” maintenance, and/or property division issues.

If agreement between common law spouses cannot be reached, then the Court will settle these disputes. To ensure your position is advanced and your interests are properly represented, it is wise to consult with a lawyer who has experience and knowledge in these matters.
